And this is the final argument to accuse her of drugging Kamila. The case is closed!
In the US, she would have to have another adult present (parent, guardian, etc.) in addition to the lawyer. I have no idea what the protocol is in this situation.I wonder, is Kamila allowed to speak with her lawyer alone for advice? Since she is underaged?
In the US, the general rule is that if a third party is present in a discussion with an attorney, the conversation is no longer protected by the attorney-client privilege. A juvenile may be able to have parents present in some cases where the parents are helping to devise strategy but if the parent/guardian is just there for emotional support, the privilege will be lost.In the US, she would have to have another adult present (parent, guardian, etc.) in addition to the lawyer. My heart goes out to Kamila. I do hope she has been able to communicate with her family and friends who aren't involved with Team ET. She needs to talk to people whose top priority is her welfare -- and no one else's. At this point, IMO Team ET has too many conflicts of interest.
Sorry and I should have said some and not inferring that they all are. That's a little intense scotty...![]()
What if justice really wins and they prove that Kami is clean? You wouldnt be happy, would ya... Because there would be no punishment, and thats what all this drama is about.I hope justice wins, and that Russia in general will get harsh punishment, since they have a history of doping
After all this, I can't imagine how she could stay focused on her skating. Performers have to tune out all kinds of distractions all the time but the pressure on her right now is unthinkable. So if I understand well, Kamilla had to testify and sustain her cause, this meeting took almost 5 hours, still no resolution, and if the is to skate she will find out just before the SP. I am exhausted just trying to picture the enormity of her struggle. If I were her mum I would personally do everything I can to take her out of the Olympic village asap and keep her off the radar for a while. Are at least her parents with her?
IMO this is why news organizations should be providing technical and medical experts...to talk about stuff like metabolites, half life, etc. The skating community is blowing bubbles in the dark on this stuff.
She wouldn't be the first to be cleared after a full hearing. Jessica Calalang had to miss Worlds because of a positive test that was later proven through analysis to have been caused by a cosmetic, not a drug. Kamila could well be cleared down the line and could resume her career. What if justice really wins and they prove that Kami is clean? You wouldnt be happy, would ya... For US courts, I was under the impression that a parent or guardian always had to be present at attorney conversations if the client is a minor/juvenile; had no idea that it would affect privilege. Re: strategy, how can someone that young be expected to make decisions without adult guidance? I realize that the lawyer represents the juvenile's interests but it still seems odd to me.In the US, the general rule is that if a third party is present in a discussion with an attorney, the conversation is no longer protected by the attorney-client privilege. These proceedings, of course, may be governed by different legal principles.
A parent/guardian is supposed to be with the juvenile when they are talking to prosecutors. I'm sure that in many cases where a juvenile is represented, the parents are considered part of the legal team and can be present in discussions with the attorney. None of this has anything to do with Kamila's case, of course. Her parents are not present and it's unclear if she even has a lawyer. And different legal standards may apply. It's also important to remember that she isn't a criminal defendant. For US courts, I was under the impression that a parent or guardian always had to be present at attorney conversations if the client is a minor/juvenile; had no idea that it would affect privilege. I don't believe the ITA IOC and ISU would be appealing if there were a chance KV is clean. When you're making a legal case, you generally try to build it on firm ground. I would speculate that their position comes from a confirmed 2nd test. What if justice really wins and they prove that Kami is clean? You wouldnt be happy, would ya... Etrie’s students are made of steel, they are trained through vigorous routines. Facing all odds and obstacles. This probably is a piece of cake for her, not a normal 15 year old. She should get the OGM if she is onequal playing field as the rest of the skaters, not with TMZ in her system..After all this, I can't imagine how she could stay focused on her skating. New idea: if she's allowed to compete and skates well, I'd give her the OGM just for sheer courage and guts!
She’s still human.Etrie’s students are made of steel, they are trained through vigorous routines. Facing all odds and obstacles. This probably is a piece of cake for her, not a normal 15 year old. Yeah, the "right" decision, or the most desired one? Funny how the important questions are not asked? As for example, why on Earth it took 2 months to suddenly get a positive sample? Now some people want an actual doper to get away with it?? Make it make sense.
I just hope I wake up tomorrow to the right decision on the news: "No Olympics for Valieva, and coaches banned for life."
