Peacock this season

I think this is seven pages of discussion based on a misunderstanding. Or ”fake news” ( God I hate that term). I just renewed my USFSA membership and this was the email I received, in part:

Our partnership with NBC Universal continues to be strong. This season, there will be 80-plus hours of figure skating on NBC and its family of networks. Television coverage will showcase the 2023 Toyota U.S. Figure Skating Championships, ISU Grand Prix of Figure Skating Series, ISU World Championships, ISU Four Continents Championships, ISU European Championships and more. Live and on-demand streaming coverage of figure skating, synchronized skating and other competitions, will continue to be available on Peacock Premium and the U.S. Figure Skating Fan Zone.

This suggests that the events will be shown as in the past. Three other points:

1. That “text conversation” screenshotted on another site (not exactly the most reliable source for news) at the beginning of this thread is clearly a conversation with a bot, not a customer service rep. The bot was likely responding to a question about whether that specific Challenger figure skating event was going to be streamed. The bot is programmed to give only the most general responses. It is almost certain that no one was actually answering the texter’s actual questions.

2. Likewise, the tweet from USFSA appears to only be a response to the question about whether “last night’s programs” will be streamed, not, as interpreted, to mean that there would only be live events this season.

3. Copyright issues pertaining to music are almost certainly not a factor in any of this. Acquiring rights to music is a basic part of the entertainment/sports business. NBC has substantial experiences in dealing with copyright licenses and it would be a non-issue.

Unfortunately, it doesnt seem to be that simple anymore.....When there were earbugs given out at comps, I would always tune into the channel of the technical talking heads to hear what they said. Then mute them when skaters I liked were on the ice. You could text them questions. One was about who pays for the music. At the time, some years back, IIRC Jimmy Santee said the federation/Association would contact the company that controlled the song and pay them. I remember that cause I was taken aback that it wasnt up to the skater.....

So lets say a skater...Jason Brown... wants to skate to "Country Joe and the Fish"

There is a real possibility that this song is controlled by a company. So they can give permission to use the song at a comp(s), at a comp that will be broadcast, or at a comp that will be broadcast and them streamed. I personally have not seen the format of the permission but would like to.

But what if the song only belongs to a group? A group that got into legal trouble over that very song. The song faced a legal challenge from the estate of New Orleans jazz trombone pioneer Edward "Kid" Ory, whose daughter Babette claimed that McDonald had appropriated the melody for his song from Ory's classic "Muskrat Ramble" as recorded by Louis Armstrong & his Hot Five in 1926. A 2005 judgment upheld McDonald's copyright on the song, claiming that Ory had waited too long to make the claim.

Does one then contact the group if still alive and the rights have not reverted to the heirs? As we have seen, there are people who write songs, and sing or play them...then others who use the music for their own versions. Hopefully, like in Sarah Brightman's case with Nella Fantasia and Ennio Morricone, all the lawyers for all the people involved made sure correct permissions were given.

As to your point 3, I still would like an article on how this all works....I was told the USFS pays for the song but of course they sell the broadcast rights to NBC. It sounds like in your point 3, NBC is responsible...if that is true, Let USFS step up and defend themselves. Sounds to me like technology has outpaced legality.....

Last year US Nationals were streamed on the Olympic Channel YouTube. But I believe it was only available to watch outside of the US (unless, of course, you had a VPN).

Everything has gotten considerably easier since then. You download the VPN, install it, select the country you want and off you go

You are not wrong. This bravo sierra /cluster/fubar is gonna cost NBC lots of bucks. And my donations to the USFS are NOT going up...I am very disappointed in them. They could at least say that their lawyers have told them to keep their pie holes shut. They could tell us in a de facto sense what is going on. "We are developing a new way that skaters get their music OKed for use at different skating levels" for instance. Without getting political, I can say that the last few years have made me very disappointed in the Sport as a whole as far as certain factors in the sport but mostly how I am treated as a person who has put over $100,000 into the sport in various ways. (This next season probably $5,000 alone. ) From the IOC to the ISU and down to the USFS. My skating buddy "Howard" who has roomed with Frank Carroll in their skating days has given up on attending events entirely and cruises instead. After 8 cruises, I can see why...it is nice to be treated like a person who is cared about.....and there are still pretty girls to talk to!

All I can say is...I spent an hour chatting with Peacock support (3 different people) and the people I chatted with were either not bots or could pass the Turing test. They were ESL speakers. I have no issue with ESL speakers, my second language is terrible, but I would not go to Spain and try to get a job on a help desk. So I did get 3 different answers. But they all had to do with streaming rights.

Many, many people have contacted NBC/USFS and never gotten an answer such as "the problem with replays only existed with that competition." They could shut all these people down from bugging them by releasing a statement that replays will be happening, then referring people to that statement.

Clearly copyright issues were an issue last seasons. There was a lawsuit and a settlement.

The copyright issue last year was an aberration. Obtaining rights to music is usually a simple and straightforward practice. These particular musicians appear to be particularly litigious and must not be members of ASCAP or BMI, who typically handle licensing for music copyright holders. This is why in all the decades of skating broadcasts, you have not seen a lawsuit before. Note that this was a settlement as well; that does not mean there was anything done wrong here. At any rate, NBC Universal is a billion dollar company. One lawsuit from a disgruntled musician is not going to affect their business practices.

Another important thing to note is that the issue of copyright on the music which the skaters use is completely different than the rights to the broadcast and streaming of the competition itself. Those rights are negotiated between NBC and USFSA. At least according to the email I received from USFSA, the plan is to air competitions as in the past, which would appear to be the announcement you are looking for. I don’t think anyone outside this forum discussion (which again, appears to be based on a misinterpretation of a couple social media posts) has any concern about the events not being broadcast and streamed, which is probably why there is no “official announcement“ from USFSA. With all due respect to the hardworking customer service reps at Peacock, I doubt they know anything about streaming rights.

A few other things raised in this thread: you will never see an article following up on Knieram/Fraser’s lawsuit because it was such a minor case. Also, you don’t need permission from Mozart. Copyright law for music at the federal level only came into existence from 1972, and the term of copyright is limited (currently life of the author plus 70 years). Finally, the absence of lyrics makes no difference; copyright exists on both the music and the lyrics, as well as any performance of the work.

This is not true (that this board is the only place this is being discussed). There are many threads on social media, most if not all of which reference both USFSA and Peacock. There is a template letter with email addresses to send on Instagram. So there is a campaign to get replays. How many people have actually been using it I do not know.

Well, it’s all the Testosterone replacement therapy I am on,,, ,I still like to talk with pretty girls.....I love ships and I like being at Sea, especially in rough weather...and I love the Panama Canal and seeing tidewater glaciers calve and sunset over the Hawaiian islands and seeing volcanos spill their lava at night....and walking around strange countries. I still like seeing all my friends at nats and Four CCs and SA for sure...but after 30 years of events, going to some cold dark dirty city in January has lost its charm. Especially with the collapse of a perfectly working airline system....Still, there are pretty girls at skating events!

This was a Challenger event. You don’t see much, of any, minor league baseball or development basketball on demand or even broadcast, for that matter. Now we could have an interesting discussion about why the Little League World Series is broadcast and a Fastest Dog competition was aired on ABC (!) last weekend, but these are business decisions made based on fan interest. Evidently NBC has declined to pay for the rights to the Challenger events based on their analysis of fan interest. They can’t broadcast/stream or offer on demand for every competition or athletic event.

So in that case, how does one get permission for an artist who is dead but has not been dead for 70 years (but died after 1972)?

BMI and ASCAP are two large entities that handle the rights of most musicians. Someone seeking to use a copyrighted piece would obtain a license/permission from one of these organizations. Most permissions do not come from the individual artists. Royalty fees are then passed on to the artists. A deceased artist’s estate would receive the payouts.

Yes and I do, but its tricky...I cruise again in December...Jan is nats and feb is 4 ccs...one week later.
Hard to do the panama canal or Hawaii in Jan or Feb '23 due to that. Dec is a great month to cruise to Hawaii but I am behind the gun due to climate change as far as ranch work.....hottest summer on record...hotest aug, sept and Oct is so far 10 degrees plus higher than normal...latest 90 on record....all the trees are stressed. If I dont take some out, there wont be enough water for the rest.....I walked 60 miles in the last 8 days chipping, shredding, felling, limbing, splitting.
But yes, you can do some events and some cruising, which I am doing
