There are four recitals in the decision:
- there are specific sanctions for protected persons, but not specific provisional sanctions. Well, I have always been taught there are no loopholes in law, only rules which are as they are and always give a result, even an unsatisfactory one. Here, the court explicitly rules that since there are no specific rules regarding provisional suspensions of minors, they won't apply the rules which exist and are common for adults and minors. Not convincing as far as I am concerned, but I may be biased by how the law system works in my country;
- fairness, proportionality, irreparable harm, and the relative balance of interests: in fact, that's what always happens with provisional suspensions. If it turns out you were innocent, it will be an irreparable harm. Once again, I don't find this very convincing: either there is no provisional suspension any longer, or I don't understand why such a thing is ruled for KV. Unless you see it as a "too big to fail" principle (there is no irreparable harm if you apply a provisional suspension to someone who should not get a medal... well, I don't agree with that) or if you remember that the final decision could be a reprimand only with no suspension (in which case, I could see the ruling as a call to a very slight sanction, if any). Moreover I would have expected that her latest tests being negative would have been considered irrelevant...
- She is a protected person: see above my remark about the lighter sanctions. Unless the idea is the irreparable harm would be even more cruel for a minor. I don't know...
- Issues of untimely notification of the results which impinged upon the Athlete’s ability to establish certain legal requirements for her benefit. In my opinion, it is the most convincing recital, for instance if it was impossible for her to ask for a B sample analysis and get the results in such a short period of time.
