Staviski -- Suspended Sentence (merged)

"The court sitting of the Bourgas regional court in the trial against double world champion figure skating Maxim Staviiski has been scheduled for the morning of January 10 2008...."

I just hope it's fair and that justice is done (whatever that may mean in this particular case).
 
I hope for a fair trial where his celebrity status will not bring him either advantage or disadvantage.

ITA! That would be ideal. Hope it's what actually happens!

Do they have "change of venue" for trials there? where the idea is to give the defendant a better chance at an unbiased jury. That would be difficult as I imagine most everyone has already heard something about this.
 
At least it will be over. Sometimes, it's the worry and fear of the unknown that is the most hellish thing to handle. Maxim must be a pretty strong man to get as far in life as he has. He has the love and support of many people. Whatever comes, he can overcome.

The victims and their family need and deserve to see justice done. I hope there is some sense of closure for everyone and they can move on .

I don't think they have trial by juries in Bulgaria. I think this was discussed in another thread. It's the judge(s) that make the decision.

Judges don't always come to decisions then and there (at least in the US). They listen to the testimony, then review the evidence and that can take days or even weeks. If there is more than one judge (as can be the case in other countries) then that takes extra time, too.

So Maxim's 'day in court' may not be the end of the waiting.
 
I agree with what they say on CSI, that witnesses are undependable, and that the only dependable thing is the evidence. For example, in the U.S., many prisoners convicted of rape, have been set free because DNA testing was applied to their cases. I remember the historically famous case where Abraham Lincoln showed that a witness's account could not be accurate, because the witness claimed that they saw what happened clearly by the bright moonlight that night, and the Farmer's Almanac showed there was no moon that night.

Something that I do not understand at all, is that Maxim's alcohol blood level is now announced as higher than it was announced before; I find that most peculiar. Based on undependable media reports, many people have pre-judged Maxim. Some have pre-judged him, because of tragic events in their own lives. That is understandable, but every case is different, and no one's fate should hinge upon the bad experiences of others, in which they were no way personally involved. In the U.S., it is said that everyone is presumed innocent, until proven guilty. Maxim has already been tried and convicted by too many posters on the Net, but I hope with all my heart, and I pray, that Maxim will get a fair trial in Bulgaria.

The court grounded his decision on the law that orders a major in full consciousness must file such a claim by himself. The court ruled he suffered minor injuries so he would not receive the BGN 5,000 compensation demanded."

I would hope that the delay is so that the two victims can re-file their claims (the young lady in her own name and the brother for a lesser sum) --- I can't believe that he will be permitted to avoid paying anything to these people.

In the US, if a crime victim is not awarded all their damages as part of the restitution ordered in the criminal case, they can still bring a civil suit. Are Maxim's victims still able to sue for additional damages? Is the amount awarded reasonable by Bulgarian standards?
