Ban on Carolina Kostner Over

Okay...16 months. But she's going to submit an appeal to the Court of Arbitration for Sport. Let's hope something fruitful happens with her appeal.

She ought to watch herself. The CAS' ruling is final and there are no more appeals - but they may decide that because this new rule which caused the leniency only came into force this year, it doesn't apply to her situation, which would make her ban longer.
 
I´m no sure, but when you appeal the court can accept or not the appeal, am I wrong? And also if the court agree with the ruling but they think the sentance was too soft couldn´t they rise her ban?.

Yes, the court can decide to accept or reject her appeal and if they do, there is very much the risk of her suspension to be increased.

There is that possibility. *sigh* Well, I wish her all the best for her appeal. Hopefully, it would come to some good, if not, I hope there isn't any extensions to her ban.
 
For the sake of information, Carolina's medals were never in jeopardy, as a medal can only be stripped in case the ban is for actual doping use. That's why the ban for doping use is retroactive: all results achivied under the effect of doping are obliterated.
I know a lot has been speculated here about this, but it was never the case.
 
She lied straight to the faces of anti-doping agencies to cover for her boyfriend. Who she knew was breaking the rules. She KNEW he was doing something wrong! Whether she knew he was taking drugs or she knew he was in a different place to where he'd told the authorities and hadn't told them, she KNEW he was breaking the rules. The rules that she herself was bound to as an elite athlete.

Sorry, you actually think she should have just been able to skip off into the sunset?

It seems that some fans hold their favored skaters to a different set of standards of justice...
 
Carolina knew better but was most likely blinded...in court we have spousal privilege in the US and I would be for such an exemption internationally but since he was just her boyfriend she still wouldn't qualify...I also don't buy that she didn't know that he was doping and I just hope that she wasn't too...

It is againts the rules? I didn´t knew. I thought she simply could do shows like Disney on Ice or SoI, etc.

I am not certain, but someone brought up earlier in this thread that there were certain rules about banned skaters skating in ISU-sanctioned shows with eligible skaters. I do not know the precise rule, but if there is such a rule, I hope every eligible skater who wants to skate in a show that Carolina is also doing is careful.
 
Interesting decision. But Carolina gets to keep her medals and imho that was the right decision. If we try to work this out, and I know many have different views, one could have a horrible criminal record but as long as it does not directly affect the competition of the sport ie you physically injured a competitor, bribed a judge ec. then that really goes perhaps to your personal reputation and image. Arguably a skating federation could send a skater with a bad criminal record as long as they did not do something directly to affect the competition and they could compete and or win a medal - unless the ISU or whoever says morality or image is also to be examined in competing which I don't think it is (sure a police officer, judge, lawyer and such may need to have a clean crim record but I am not sure a skater needs to be and that it affects the skating - maybe their pesonal reputation or credibility but that is not skating).

If she does that, it might backfire on her and end up with her getting stiffer penalty.
 
The ban seems completely reasonable to me.

I hope that the skaters who are caught up in this ridiculous #IStandWithCarolina thing aren't so blinded as to not check on the rules for skating in shows with a banned skater. I'd hate to see anyone's eligibility messed with because of her.

FWIW, I think going to CAS is a waste of time for Kostner, but I have no patience for people who react to what she did as though she'd been covering for a child molester or something. She told doping inspectors to go look for Schwazer where he said he'd be and told him to go there too. How evil! How depraved! Give me a break.

Kostner can still make loads of money skating in shows with retired skaters, like her recent appearance at Lambiel's Ice Legends. I hope she does.

That depends. I guess first the CAS has to accept the appeal. Then they will fix a date for hearing. The hearing and the new sentence.

So if the CAS accept the appeal I´m guessing at least 2 to 3 months?

I agree with the people that have voiced that the penalty is adequate, under no circunstance Carolina should have lied, and being a good person shouldn´t excuse you from owning what you did.

This isn't a legal issue in the conventional sense. It's being pursued though sports bodies, not the legal system. If Kostner hadn't been an athlete herself, there would be no case.

Maybe her friends think that her minor role in this whole mess doesn't warrant the kind of censure she's receiving.

It is, under Italian law colaboating and covering up doping is a crime, Carolina is lucky they didn´t decide to persue a criminal sentence.

But Kostner did do something obviously, legally wrong. Support her all you like, but the fact remains she blatantly lied to coverup the whereabouts of her boyfriend. Actions have consequences. She's just very lucky that we live in a world where celebrity status makes those consequences less onerous. Well...at least for celebrities.
